It may sound crazy, but yes, you can temporarily give your parental powers over your minor child to someone else. I know what you’re thinking, and no, do not just drop your kids off at nana’s house with a piece of paper and head to Vegas.

The statutes that govern the Parental Power of Attorney are as follows:

14-5104. Delegation of powers by parent or guardian

A parent or a guardian of a minor or incapacitated person, by a properly executed power of attorney, may delegate to another person, for a period not exceeding six months, any powers he may have regarding care, custody or property of the minor child or ward, except power to consent to marriage or adoption of the minor.

14-5107. Military member power of attorney; definition

A. A military member who is a parent or guardian of a minor child or ward may delegate to another person, for a period not to exceed one year, any powers the parent or guardian have regarding care, custody or property of the minor child or ward, except the power to consent to marriage or adoption of the minor child or ward.

A Parental Power of Attorney (PPOA) is a very useful tool to use as a precaution when you are not going to be around your kids for a specific amount of time. As you can see, the PPOA can last no longer than six months unless you’re a military member – which allows for a year. It must begin and end on specific dates, and it can be revoked (in writing) at any time for any reason. Also, the person you delegate your parental rights to (called an “agent”) must be willing to accept those rights.

Common uses for the PPOA are if you are having a surgery or if your child travels with grandma and grandpa. This way your agent can seek medical care if your child breaks his or her wrist when they are running, because let’s be honest, you know your kids are nuts!
